ARTICLE 2 – SUBJECT OF THE AGREEMENT
The subject of this agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, regarding the sale and delivery of the product/products, whose qualities and sales price are specified below, which the BUYER orders electronically through the www.find-myparts.com platform belonging to the SELLER.

ARTICLE 3 – GENERAL PROVISIONS
1. The parties to this agreement are the BUYER and the SELLER, and all obligations and responsibilities related to the fulfillment of this agreement belong to the parties; The Parties acknowledge, declare, and undertake that Ayda Cavuldar, who is not a party to this agreement, has no obligations or responsibilities. This agreement enters into force on the date it is electronically approved by the BUYER.
2. The BUYER acknowledges, declares, and undertakes that he/she has read and is informed about the preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to this agreement on the www.find-myparts.com platform and has provided electronic confirmation.
3. The product subject to the contract is delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified in the preliminary information, depending on the distance of the BUYER’s place of residence, not exceeding the legal 30-day period for each product. If the product cannot be delivered to the BUYER within this period, the BUYER reserves the right to terminate the contract.
4. The SELLER is responsible for delivering the product subject to the contract in a sound, complete, and compliant manner with the specifications stated in the order, and with warranty documents and user manuals, if any.
5. For the delivery of the product subject to the contract, this agreement must be approved electronically and the sales price must be paid by the payment method preferred by the BUYER. If the product price is not paid for any reason or is canceled in bank records, the SELLER is deemed to be relieved of the obligation to deliver the product.
6. If the relevant bank or financial institution does not pay the product price to the SELLER because the BUYER’s credit card is used unfairly or unlawfully by unauthorized persons after the delivery of the product, the BUYER is obliged to pay the product price to the SELLER within 3 days.
7. The BUYER will inspect the product subject to the contract before delivery; He/she will not accept the damaged and defective product from the cargo, such as crushed, broken, torn packaging, etc. The delivered product will be deemed undamaged and intact. After delivery, the responsibility for the product belongs to the BUYER.
8. The BUYER agrees not to use the products he/she purchases for commercial purposes.
9. The www.find-myparts.com platform is a platform where SELLERS display their products and mediate their sales. The responsibility for the quality of the products, warranty conditions, and other matters belongs to the SELLER. Ayda Cavuldar (www.find-myparts.com) only provides platform services.
10. Customs and Other Expenses for International Shipments: In the event that the BUYER’s order is sent abroad, all kinds of customs duties, customs clearance expenses, other taxes and fees that may arise at the entry of the product into the BUYER’s country belong to the BUYER. FindMyParts has no responsibility for these expenses. The BUYER must research the customs legislation in his/her own country before ordering and consider these expenses. It is the Buyer’s sole responsibility to ensure that the purchased items comply with all import regulations and restrictions of their country. FindMyParts is not responsible for any items seized or rejected by customs due to non-compliance with these regulations.
ARTICLE 4 – RIGHT OF WITHDRAWAL
1. The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product subject to the contract to him/her or the person/organization at the address he/she indicates, without giving any reason and without paying any penal clause.
2. In order to exercise the right of withdrawal, it is obligatory to notify the SELLER in writing by registered mail, fax, or e-mail within this period and that the product is not within the scope of “Products for which the Right of Withdrawal Cannot Be Exercised” regulated in this contract.
3. In case of exercising the right of withdrawal:
* a) Invoice of the product delivered to the 3rd person or the BUYER (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the institution when returning it. Order returns issued on behalf of institutions cannot be completed unless a RETURN INVOICE is issued).
* b) Return form,
* c) The box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.
4. The SELLER is obliged to return the total price and the documents that put the BUYER in debt within 14 (fourteen) days at the latest from the receipt of the withdrawal notification and to take back the product within 20 (twenty) days.
5. If there is a decrease in the value of the product due to a reason arising from the BUYER’s fault or if the return becomes impossible, the BUYER is obliged to compensate the SELLER’s damages in proportion to his/her fault.
6. If the campaign limit amount set by the SELLER falls below due to the exercise of the right of withdrawal, the campaign discount amount will be canceled.
ARTICLE 5 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Products that cannot be returned due to their nature, products prepared in line with the BUYER’s special requests or personal needs, products that may spoil quickly or have an expiration date, products whose protective elements such as packaging, tape, seal, and package have been opened after delivery; Products that are not suitable for return in terms of health and hygiene, products that are mixed with other products after delivery and cannot be separated, products provided within the scope of the subscription agreement, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, audio or video recordings (DVD, CD, etc.) ), the return of software programs and computer consumables is not possible if the package has been opened by the BUYER.
The BUYER acknowledges that the information regarding the right of withdrawal has been duly provided in accordance with the Distance Contracts Regulation.
ARTICLE 6 – INCORRECT NOTIFICATION OF THE DELIVERY ADDRESS BY THE BUYER
The Buyer is responsible for providing an accurate delivery address. If the address provided is incorrect or incomplete, resulting in delivery failure, FindMyParts will attempt to contact the Buyer to correct the information. If the Buyer cannot be reached within three (3) business days, the order will be returned to the Seller, and a refund will be issued minus any applicable shipping costs. The Buyer is responsible for all shipping costs associated with incorrect address information, including return shipping and re-delivery if applicable. FindMyParts is not responsible for delays caused by incorrect address information.
ARTICLE 7 – DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on transactions made with a credit card, he/she will pay interest within the framework of the credit card agreement made by the cardholder bank with him/her and will be liable to the bank. In this case, the relevant bank may resort to legal remedies; It may request expenses and attorney fees from the BUYER, and in all cases, if the BUYER defaults due to his/her debt, the BUYER acknowledges, declares and undertakes to pay all kinds of damages and losses incurred by the SELLER due to the delayed performance of the debt.
ARTICLE 8 – RESOLUTION OF DISPUTES
Turkish Law will be applied in the resolution of legal disputes arising from the application and interpretation of this agreement. Ankara Central Courts and Enforcement Offices will be authorized for all disputes that may arise between the parties regarding the interpretation and application of the provisions of this agreement.
ARTICLE 9 – ENFORCEMENT
The BUYER declares that he/she has read, understood and accepted all the conditions written in this agreement and in the preliminary information form, which forms an integral part of it. This Agreement enters into force at the moment it is approved electronically by the BUYER.
**ARTICLE 10 – INVOICING RESPONSIBILITY**
**The BUYER acknowledges and agrees that www.find-myparts.com is a platform facilitating sales between independent SELLERS and BUYERS. Following a purchase, the invoice for the transaction will be issued by the SELLER of the product, and will include the SELLER’s details, including but not limited to their name, address, and any applicable tax identification number. www.find-myparts.com (Ayda Cavuldar) is not responsible for issuing invoices for these transactions.**
